The Pink Corner LLC. (the “Company,” “Store”, “we” “our” or “us”) operates www.thepinkcorner.shop (the “Site”).  This page informs you of our policies regarding the collection, use, and disclosure of Personal Information that we receive from users of the Site.

We use your Personal Information only for providing and improving the Site.  By using the Site, you agree to the collection and use of information in accordance with this Policy.

When you purchase something from our Store, as part of the buying and selling process, we collect the personal information you give us such as your first and last name, mailing and billing address, email address, and credit card information.

When you browse our Store, we also automatically receive your computer’s Internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

With your permission, we may send you emails about our Store, new products and other updates.  You must provide permission to receive these emails by signing up for our mailing list.

2. INFORMATION YOU PROVIDE

You provide us information about yourself, such as your name and e-mail address, if you register for an account with the Service, including by connecting with the Service via a third-party service, or by “following,” “becoming a fan,” adding the Service application, etc., on a third party website or network.

3. INFORMATION WE COLLECT AND USE

We may use your email address to send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). If you don’t want to receive these messages, you can opt out by following the instructions in the message. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.

Text Marketing and notifications:
By entering your phone number in the checkout and initialising a purchase, subscribing via our subscription form or a keyword, you agree that we may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. Text marketing messages will not exceed 30 a month. You acknowledge that consent is not a condition for any purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you with in any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. Message and data rates may apply.

4. CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, and/or arrange for a delivery or return a purchase, you consent to our collection and use of such information for those specific purposes only.  

If we ask for your personal information for a secondary reason, like marketing, we will ask you directly for your expressed consent to provide us with such information.

5. DISCLOSURE

We may disclose your personal information to appropriate law enforcement agencies if we are required by law to do so.

6. LOG DATA

Like many site operators, we collect information that your browser sends to us whenever you visit our Site (“Log Data”).  This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages, and other statistics. 

In addition, we may use third party services, such as Google Analytics, to collect, analyze and monitor this Log Data.

7. SHOPIFY

Our Store is hosted on Shopify Inc., an online e-commerce platform that allows us to sell our products and services to you.  Your data is stored throughout Shopify’s data storage, databases, and the general Shopify application. Shopify stores your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, Shopify will store your credit card data, which is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways must adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our Store and its service providers.

8. THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. 

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or we are located. Therefore, if you elect to proceed with a transaction that involves the services of a third-party service provider, your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our Store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

9. SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure your information is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. 

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards, but cannot guarantee its absolute security.

10. COOKIES

Cookies are files with small amounts of data which may include an anonymous unique identifier.  Cookies are sent to your browser from a web site, and stored on your computer’s hard drive.  Like many sites, we use “cookies” to collect information.  You can instruct your browser to refuse all cookies, or to indicate when a cookie is being sent.  However, if you do not accept cookies, you may not be able to use some portion of our Site.

Below, we have provided a list of Cookies that we use:

 _session_id: unique token, sessional.  Allows Shopify to store information about your session (referrer, landing page, etc). 

 _shopify_visit: no data held.  Persistent for 30 minutes from the last visit. Used by our website provider’s internal statistics tracker to record the number of visits to our site. 

 _shopify_uniq: no data held.    Expires at midnight of the next day after the customer’s visit. Counts the number of visits to a store by a single customer.

Cart: unique token.  Persistent for 2 weeks. Stores information about the contents of your cart.

 _secure_session_id: unique token, sessional.

 storefront_digest: unique token.  Indefinite If the shop has a password, this is used to determine if the current visitor has access.

PREF, persistent for a very short period.  Set by Google and tracks who visits the Store and from where they visit.

11. AGE OF CONSENT

 By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

12. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is effective as of Month Date, 2023, and will remain in effect with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

As we reserve the right to modify this Privacy Policy at any time, please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here and/or via the email address you provide, that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If the Company is acquired or merges with another company, your information may be transferred to the new owners so that we may continue to sell products to you. 

13. INDEMNIFICATION

You agree to indemnify, defend and hold harmless The Company and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Privacy Policy or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

14. SEVERABILITY

If any provision of this Privacy Policy is found invalid or unenforceable under any circumstances, such invalidity or unenforceability shall not affect any other provision or application of this Privacy Policy which can be given effect without the invalid or unenforceable provision or application and shall not invalidate or render unenforceable such provision or application.

15. ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of this Privacy Policy shall not constitute a waiver of such right or provision.  The terms in this document constitutes the entire agreement and understanding between you and us regarding this Privacy Policy, and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us. 

Any ambiguities in the interpretation of this Privacy Policy shall not be construed against the drafting party.

16. GOVERNING LAW AND JURISDICTION

This Privacy Policy shall be governed by California law in the United States of America.  The parties shall have been deemed to have consented to California jurisdiction, specifically within the County of Los Angeles. 

17. MEDIATION

The Parties will first negotiate, then mediate, any dispute or claim between them arising out of this Privacy Policy, or any resulting transaction, before resorting to arbitration or court action, subject to exceptions below.  If for any dispute or claim to which this Paragraph applies, any party commences an action without first attempting to resolve the matter through mediation, or refuses to mediate after a request has been made, then that Party shall not be entitled to recover attorney fees, even if they would otherwise be available to that party in any such action. 

18. ARBITRATION

WITH THE EXCEPTION OF SMALL CLAIMS MATTERS, THE PARTIES AGREE THAT ANY DISPUTE ARISING OUT OF THIS PRIVACY POLICY OR ANY RESULTING TRANSACTION WITH THE COMPANY, WHICH IS NOT SETTLED THROUGH MEDIATION, SHALL BE DECIDED BY NEUTRAL, BINDING ARBITRATION IN THE COUNTY OF LOS ANGELES, CALIFORNIA BEFORE THE AMERICAN ARBITRATION ASSOCIATION (“AAA”). THE ARBITRATOR SHALL BE CHOSEN BY THE PARTIES, UNLESS THEY CANNOT AGREE, IN WHICH CASE AAA SHALL SELECT THE ARBITRATOR. THE DEFAULT COMMERCIAL RULES OF AAA SHALL APPLY. JUDGMENT UPON THE AWARD OF THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION. THE PARTIES SHALL HAVE THE RIGHT TO LIMITED DISCOVERY IN ACCORDANCE WITH THE CALIFORNIA CODE OF CIVIL PROCEDURE.

19. ATTORNEY’S FEES

If any action, suit, or proceeding is instituted to interpret, enforce, or rescind this Privacy Policy, or otherwise in connection with this Privacy Policy, the prevailing Party will be entitled to recover, in addition to any other relief awarded, the prevailing Party’s reasonable attorneys’ fees and other fees, costs and expenses of every kind in connection with the action, suit, or proceeding, any appeal or petition for review, the collection of any award or the enforcement of any order, as determined by the arbitrator and/or court.
